Засоби державного регулювання депозитарної та клірингової діяльності в Україні / The Means of State Regulation of the Depository and Clearing Activity in Ukraine

Abstract

State regulation of the depository and clearing activity can be defined as the implementation by the state, in the person of its competent authorities, of a set of economic, organizational (managerial) and legal measures to order, control, prudential supervision of depositary and clearing activity, and prevent abuse and violation in this area. The means of state regulation of economic activity are understood as the statutory economic, organizational and legal instruments (tools) of the state regulating influence in the person of the authorized bodies on the activities of economic entities. The article presents the main means of state regulation, through which the current management of depository and clearing activity is provided. Among them: licensing of depositary and clearing activity in the stock market; state registration; means related to the liquidation of depositary and clearing participants; application of the permission procedure; establishment of a list of securities serviced by the depository system of Ukraine; appointment of temporary heads of depositaries; stopping clearing; establishment of requirements, criteria and standards for the providing of the depositary and clearing activity in the stock market; the formation and maintenance of the stock market information database; certification of specialists of depository and clearing institutions; setting requirements for managers and chief accountants; establishment of disclosure requirements. The necessity of the state's use of such a means of state regulation as the establishment of prices and tariffs for the services of depository and clearing institutions is substantiated.
