Abstract
The usage of alternative dispute methods in cases of medical events The article addresses the topic of innovative usage of alternative dispute methods which is applied in cases of medical events. In chapter 13a of 6 November 2008 Act on the Patient’s Rights and the Patients’ Ombudsman, a legislator set County Committees for the Adjudication of Medical Events – specialized quasi-judicial organs which adjudicate in proceedings between hospitals and patients since 1 January 2012. Undoubtedly, the ratio legis in introducing these new institutions was the facilitation of common courts by taking away the burden of cases of medical malpractice. The aim of this was to create cheaper, quicker and more effective alternatives for the civil procedure. In this paper the essence of alternative dispute resolution will be explained and the most important distinguishing features of particular forms will be described. Furthermore the authors will demonstrate that the process of proceedings in front of the County Committees for Adjudication of Medical Events, which is based on elements of mediation, conciliation and arbitration, is a completely new and unique method of settling disputes in medical law.
