FORMS OF CRIMINAL PROSECUTION: STATE OF THE RESEARCH OF PROBLEMS

Abstract
The article is devoted to the analysis of forms of criminal prosecution. In the work author analyzes the approaches of different scientists to the definition of criminal prosecution, and determines that the lack of a common understanding of criminal prosecution in the doctrine of criminal procedural law can also be displayed on the differences between understanding of forms of criminal prosecution. Also in the work author concludes that the notions of “forms” and “types” of criminal prosecution are synonymous, which makes it possible to consider articles of scientists both on types and forms of criminal prosecution. At the same time, author adheres to established point of view and also identifies two forms of criminal prosecution: private and public criminal prosecution.
