Human rights in the system of compliance with international standards: general theoretical analysis

Abstract

The article deals with the concept, essence and types of international human rights standards. The modern catalog of human rights is enshrined in both international legal documents and in the constitutions of coun-tries. In addition to pre-trial and judicial protection of human rights, which is carried out within the framework of the domestic law of the states and is based, in most cases, on the provisions of the national constitutions, there is an international mechanism of protection guaranteed by international law and of uni-versal significance. It is noted that the international cooperation of states in the field of human rights takes plays in the form of adopting certain standards concerning the content of the individual’s legal status and the commitment of states to adhere to these standards in their domestic legislation and in their daily activities. It is found that the international mechanisms for the protection of human rights, to which Ukraine has joined, is an additional guarantee for implementing the right to protection. With the independence, democratization of all spheres of society's life is the main vector of Ukraine's development as a European legal state. In this area, one of the most effective guarantees of the protection of human rights is international institutions. The latter are an opportunity to ensure the observance of human rights in Ukraine through effective national mechanisms of guaranteeing by the state and civil society institutions.
