Legal status of the participants of the State concern “Ukroboronprom” and the legal regime of their property (part one)

Abstract
The article deals with the legal status and legal regime of property of enterprises that are members of the State concern “Ukroboronprom”, the leader of the defense industry of Ukraine. A brief excursion into the history of the development of legislation on state-owned enterprises in Ukraine is outlined; defined the notion of “state enterprise”, “state unitary enterprise”, “state commercial enterprise”, “state enterprise”, “economic management”, “operational management”. For the first time the characteristics of a state commercial enterprise and state-owned enterprise according to the Commercial Code of Ukraine, which are inherent to the participants of the State Concern “Ukroboronprom”, are systematized. The practical aspect of prosecutorial supervision over observance of laws at enterprises of the defense industry complex is considered on the example of actual jurisprudence. The ways of improvement of the current general and special legislation on the considered issue are offered.
