ОРГАНИ ДЕРЖАВНОГО УПРАВЛІННЯ ТА МІСЦЕВОГО САМОВРЯДУВАННЯ ЯК ЕЛЕМЕНТИ ПУБЛІЧНОЇ ВЛАДИ

Abstract
The article is devoted to the study of some aspects of public administration and local government bodies as elements of public authority. The nature of local self-government is considered, which is that it is, on the one hand, an analogue of the central government, and on the other – a form of democracy, which ensures the realization of the rights of citizens to local self-government, and the local population – the possibility of transforming their will into public power. The purpose of the article is a brief review of scientific legal literature, first of all – domestic, in which the bodies of state administration and local self-government are analyzed as elements of public power, the direction of which is aimed at ensuring sustainable, stable development of society and the state. The evolution of the theoretical heritage of the classics of European political and philosophical thought suggests that both civil society and the rule of law become possible only when the law and the contract are the determining factor of socio-political relations. The real embodiment of the interaction of the principles of the rule of law and civil society can be traced on the example of various forms of organization of power, namely: democratic, legal and social state. If a democratic state is a regime of government that represents the interests of a political majority by means of electoral law, the rule of law specifies this provision, since it also provides guarantees for the protection of minority rights from the dictates of the majority. Local self-government should be understood as an element of the status of a person and a citizen, expressed in the will of the person, his right to participate in matters of the local community; as a principle of organization (decentralization) of power in the state; as a form of public power in the state; as the activity of citizens or bodies created by them for solving local problems caused by common interests in the territory of its municipal entity.
