Abstract
The scientific article is devotes to the analysis of provision of paragraph 3, article 2 of the Labour code of Ukraine project, which states the presumption of legitimacy of legal position, decision or action of an employee. Legal nature of this provision, its correlations with paragraph 2, article 17 of the Labour code of Ukraine project, is found out.
