РОЗВИТОК ТЕОРІЇ ПРАВОВОГО СТИМУЛЮВАННЯ У НАУЦІ ТРУДОВОГО ПРАВА

Abstract
The article explores the development of the theory of legal stimulation in the science of labor law. The controversial aspects of the emergence of a legal institution of stimulation in the system of labor law are analyzed. On the basis of the analysis of legal literature, the conclusions about the influence of scientific concepts on the formation of an effective mechanism of legal stimulation on the participants of labor legal relations are made. In the early twentieth century the problems of the theory of legal incentives could not yet be explored by researchers of labor law, because the labor law only started its formation on the basis of civil law. The article considers the origins of the emergence of legal incentives in the general theory of law. The achievement of an effective work of employees is significantly hampered by the lack of development a lot of aspects of legal stimulation in the theory of labor law. The problem of legal incentives as a means of legal regulation of social and labor relations didn’t receive a thorough scientific analysis. The absence of an integrant understanding of legal incentives, systems, functions and principles of its design and application, that generates significant problems at both the theoretical and practical level, is discovered. Different approaches and views on the relationship of labor law with other branches of law (administrative, tax, etc.) in the mechanism of stimulating the interest of the participants of labor legal relations are analyzed. An attention is payed to the problems of stimulating the participants of labor relations, in particular, the problem of increasing the efficiency of social production. The creation of new jobs, the establishment of a flexible system of remuneration, the strengthening of labor discipline are studied by researchers from labor law independently, without the profound use of data from related sciences (economics, sociology, psychology), that may affect the development of the theory of stimulation in general. It is emphasized, that almost all lawyers admitted the legal incentives and found further development both in the general theory of law and in various branches of law. Formulated conclusions can be the basis for further deepened development of the theory of legal incentives in science of labor law.
