СУЧАСНИЙ СТАН ЗЛОЧИННОСТІ В УКРАЇНІ У СФЕРІ ІНТЕЛЕКТУАЛЬНОЇ ВЛАСНОСТІ

Abstract
In the article the author investigates the current state of crime in Ukraine in the field of intellectual property. The author analyzes the most acute problems of criminal legal protection of intellectual property rights, which may differentiate into groups of theoretical and practical problems. Protection of intellectual property rights is one of the foundations of modern society. This is explained both by its humanist orientation in the defense of all human rights and economic expediency, since in modern society the goods and services created by high technologies dominate. However, a number of countries show a low development of national high-tech industries, which experts directly associate with low protection of intellectual property, the focus on the legal or illegal borrowing of foreign objects of relevant rights. Unfortunately, the current economic situation in Ukraine promotes the growth of demand for low-price goods. According to expert estimates, counterfeit media, clothing, household appliances, accessories, pharmaceuticals, food, alcoholic beverages and even such specific products as pesticides are the most intensive in Ukraine. The author mentioned in the article theoretical problems, namely: the qualification of specific encroachments on the intellectual property of the problem of objects: the differences in the terminology of the Criminal and Civil Codes of Ukraine: “a sign for goods and services”/“trade mark”, “brand name/ commercial name”, “topography/layout of the integrated circuits” respectively. One can also point out the problem of the objective side of crimes; practical problems, in particular: the difficulties of law-enforcers cause the documentation of crimes committed not with physical carriers, such as the facts of Internet piracy. It is still controversial that the Criminal Code provides for the need to confiscate all counterfeit products, including realized by conscientious buyers who did not know about the violation of intellectual property rights. Emerging technologies generate new forms of encroachments on intellectual property, especially on the Internet, requiring highly qualified law enforcement officers and judges.
