ТЕНДЕНЦІЇ ПОДАЛЬШОГО РОЗВИТКУ ПРАВОВОГО РЕГУЛЮВАННЯ ЮРИДИЧНОЇ ВІДПОВІДАЛЬНОСТІ ДЕРЖАВНИХ СЛУЖБОВЦІВ

Abstract
The article analyzes the tendencies of development of legal regulation of legal responsibility of civil servants. The worked out legal acts, which determine the given tendencies at the legislative level. The analysis of the current legislation has shown that all legislative priorities set by the legislator for the development of legal regulation of legal liability of civil servants have already been implemented, that is, this institution actually exists in the form in which the legislator seeks to see him for several years to come. The attention is drawn to the necessity of the reform of the civil service and the optimization of the system of state bodies, and the planned activities include: declaring the property status of public servants; prevention and settlement of conflicts of interest; verification of employees’ integrity and monitoring their lifestyle; control over the integrity of employees; creation of an effective, transparent, open and flexible structure of public administration with the use of the latest information and communication technologies; renewal of civil servants’ staff. The necessity of introducing clear and transparent mechanisms of bringing civil servants to responsibility is substantiated. The main purpose of its realization is the legislative establishment of a procedure for disclosure of information on bringing a civil servant to justice. The necessity of creating a single legal act aimed at regulating the disciplinary responsibility of a civil servant – the Disciplinary Statute – is emphasized, realization in practice is possible through the adoption of the Disciplinary Code (statute) of civil servants. It is concluded that the tendencies of further development of legal regulation of legal responsibility of civil servants are as follows: a) strengthening of responsibility of civil servants in various spheres; b) introduction of clear and transparent mechanisms of bringing civil servants to justice; c) creation of a single legal act aimed at regulating the civil servant’s disciplinary responsibility; d) replacement of the terms “official”, “civil servant” with “public servant”; accordingly, it will be about the legal regulation of the responsibility of public servants.
