THE CATEGORY “PROCEDURE FOR RESOLVING DISPUTES”: THEORY, LEGISLATION AND JUDICIAL PRACTICE

Abstract
The article is devoted to the disclosure of the content of such a category as “the procedure for reviewing disputes”, determining its relationship with the procedure for protecting subjective law, clarifying the peculiarities of determining the jurisdiction of disputes arising out of foreign economic agreements. According to the results of the analysis of the legislation of Ukraine and the existing approaches of the legal doctrine, it is proposed, under the procedure of consideration of a dispute between the parties, to understand the complex of internally agreed measures to protect the rights and legitimate interests of counteragents of the agreement provided for both substantive law and procedural, including international, on the determination of jurisdiction in the solution. disputes with a foreign element.
