The concept of marriage in the theory of family law and the legislation of Ukraine and EU member states: current trends

Abstract
The article examines the approaches to the definition of the concept of marriage contained in the legal literature and legislation of the EU member states (France, Germany, Poland and Hungary). It is concluded that, on the whole, the understanding and legal regulation of marriage as the basis for creating a family in Ukraine and the legislation of the Member States of the EU is not significantly different, which is largely due to the fact that such regulation is largely based on the reception of the provisions of Roman private law. It is noted that the main difference in the legislative definition of marriage is its definition as a combination of exactly men and women, that is, heterosexual partners or same-sex partners.
