THE GROUNDS AND PRINCIPLES OF SETTING UP CRIMINAL RESPONSIBILITY FOR NOT FULFILLING COURT DECISION

Abstract
The grounds and principles of setting up criminal responsibility for not fulfilling court decision (article 382 of Criminal Code of Ukraine) and a problem of its transformation in criminal misdemeanor against justice (part 1, article 382 of crimi- nal Code of Ukraine) are being investigated. It is mentioned that the idea of putting misdemeanor in the national criminal legislation of criminal redetermines confession of the independent type of the offence, the intermediate between minor crimes and administrative crimes. In this connection, it is marked that rather to acknowledge non-fulfillment of court deci- sion misdemeanor as carelessness.
