THE PURSUANCE BY THE AUTHORITY TO ESTABLISH THE OBJECTIVE TRUTH AND THE LIMITS OF THE BURDEN OF PROOF

Abstract
Description refers to incidentally discussed in the literature issues concerning the scope of the burden of proof, in relation to the information that the authority itself has or can get yourself. Analysis of the existing regulation leads to the conclusion that the authorities in a much wider range than it is in practice should demonstrate independence in this area. At the same time attempt was made to draw the line between the duties of the body of evidence and the activity of the parties in this regard, taking into account the specifics of obtaining certificates, which are a special kind of evidence.<br/><br/>
