The transnational corporations and the protection of human rights

Abstract

The article presents current situation of the perception of the role of trans-national corporations in the protection of human rights. The issue is so im-portant, that the contemporary model of the perception of human rights is based on the so called universality. The universalism of human rights is based on three fundamental pillars: 1) subjectivity (applicable to each person of the human by virtue of being human); 2) the territoriality (on the circle of civilization and cul-tural heritage); 3) time (on going despite the evolution of societies and nations). This justifies the search for all possible sources and routes, to today’s protection of human rights included the broadest list of entities responsible for its applica-tion and enforcement. The international debate on the links between human rights protection launched the transnational corporations in the 70’s of the 20th century. It is still valid and continues today. It affects globalization, as a worldwide phenomenon. Presented on the international scene have been the most important activity of States in order to standardise the legal relevant attitudes in the transnational corporations in the area of human rights. The most important initiatives were analysed, international organisations such as the Organisation for Economic Cooperation and Development, the International Labour Organization and the United Nations. Noted the incompleteness and a small performance of these activities. It is revealed in the absence of commonly agreed and legally binding instrument of international law, which would regulate such issues.
