Abstract
The article is devoted to consideration of the emergence of a commercial contractual relationship. In particular, it analyses the positions of scholars on this issue. The research of the history of the studied categories begins with an analysis of the rules of Roman law and ends with the analysis of the current legislation of Ukraine.
