Wyłączenie sądownictwa polubownego w rozporządzeniu Nr 1215/2012

Abstract

This article deals with the exclusion of arbitration from the subject matter scope of application of the Regulation No. 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters within the European Union. The exclusion of arbitration proceedings (conciliation proceedings) does not apply to proceedings before the arbitration court, and to the recognition and enforcement of judgments delivered by arbitration courts. Arbitration courts in their strict sense are neither public authorities of the Member States, nor they are the entities which carry out legal protection tasks on behalf of these States, but they are private organizations. Arbitration courts have no competence to refer questions for a preliminary ruling to the Court of Justice of the EU. Recognition and enforcement of arbitration awards is governed by The Convention on the Recognition and Enforcement of Foreign Arbitral Awards drawn up in New York, 10 June 1958, which prevails over the Regulation No. 1215/2012.
