Закриття кримінального провадження: вітчизняні реалії та європейські стандарти / Termination of a Criminal Case: National Realities and European Standards

Abstract

The article analyzes the official statistics of the Prosecutor General’s Office of Ukraine during 2015-2016 related to the amount of recorded criminal offences and terminated criminal proceedings along with the cases forwarded to the court with indictment. The set of trends related to existing procedure of forming and submitting reporting documents has been addressed. Attention has been drawn to the fact that statistical reporting has a lack of index pertaining the amount of registered criminal offences and its replacement with an index dealing with the amount of recorded criminal offences which to some extend distorts the understanding of the whole situation and does not give an opportunity to see the total amount of criminal cases registered during the year. The graphics show a monthly negative correlation of the amount of recorded crimes with the amount of terminated criminal cases as well as results of impact of quarterly and annual reporting on official statistical indices. Concealed procedural and statistical manipulations aimed at presenting a better image of a certain territorial law enforcement subdivision have been shown based on the statements of law enforcement officers who participated in the survey. Obvious incompliance between existing practices of termination of criminal cases with basic European standards provided for in the relevant international documents has been presented. The paper is based on research conducted by Expert Human Rights Center and International Renaissance Foundation in which the author participated.
