Abstract
The issue of embassies judicial capacity requires thorough analysis. The Code of civil procedure states that judicial capacity is a capacity to act as a party in a process. The question is whether an embassy can be a sole party in the trial. Nowadays, when international relations are dynamic, it is extremely important to clarify the matter. In 2007, the Supreme Court of Poland in the case of Eugenia C. v. The Dutch Embassy in Warsaw concerning property rented by the defendant came to a conclusion that an embassy of a foreign country does not have judicial capacity in Poland. In justification for this judgment the court stated that an embassy cannot be considered a separate legal entity from the Sending State and, as a result, cannot be an independent party to a process.
