PECULIARITIES OF ADMINISTRATIVE RELATIONSHIPS IN THE SPHERE OF IMPROVEMENT OF HUMAN SETTLEMENTS

Abstract
The article reveals the features of administrative legal relations in the field of improvement of settlements. Based on the provisions of the theory of law and the theory of administrative law, the definition of “administrative legal relations in the sphere of improvement of human settlements” is formulated. Proceeding from the theoretical material and the norms of the current national legislation, the range of administrative legal relations in the sphere of the improvement of settlements is defined, including: norm-setting activities for the establishment of rules, order, etc. in the area of the improvement of settlements; implementation of various forms of state regulation, activities in this area; coordination of activities of all subjects of relations, in particular public authorities; provision of technical and price regulation, licensing, control, and the like. The characteristic of the composition of administrative legal relations in the sphere of the improvement of settlements is given, the object, subjects and content of these legal relations are formulated. The object of legal relations is the behavior of people, certain actions or activities, and in legal relations of organizational and property nature – behavior (actions or activities) and property. The subjects of relations in the sphere of the improvement of settlements are state authorities and local self-government bodies, enterprises, institutions, organizations, bodies of self-organization of the population, citizens. The content of legal relations is determined by the subjective rights and legal obligations of the subjects, which are fixed in the provisions of special normative acts from the sphere of improvement both nationwide and local. The conclusion is made about the peculiarities of administrative legal relations in the area of public amenities and the need for a clear regulation of these relations in national legislation for the effective functioning of the sphere of improvement of settlements.
